These Terms of Service ("Terms") govern your use of the Tagrim desktop application and the tagrim.com website (collectively, the "Service") operated by Tagrim ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. License to Use

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Tagrim desktop application for your personal or internal business purposes.

  • You may install Tagrim on devices you own or control, subject to the activation limits of your license tier.
  • You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the application.
  • You may not redistribute, sublicense, rent, or lease the application.
  • You may not remove or alter any proprietary notices or labels.

2. Free Trial

We may offer a free trial period. During the trial, you have access to the full functionality of Tagrim. At the end of the trial period, you must purchase a license to continue using the application. We reserve the right to modify or discontinue the free trial at any time.

3. Payments and Billing

Our order process is conducted by our online reseller, Paddle.com. Paddle is the Merchant of Record for all orders. Paddle provides all customer service inquiries related to billing, receipts, and payment methods.

  • All prices are displayed inclusive of applicable taxes, which are calculated by Paddle based on your location.
  • By completing a purchase, you agree to Paddle's Checkout Buyer Terms.

4. Refunds

We offer a 14-day money-back guarantee on your first payment. For full details, see our Refund Policy. Refund processing is handled by our reseller, Paddle.com. Your statutory consumer rights are not affected.

5. License Keys

  • License keys are personal to you and may not be shared or transferred.
  • The application periodically contacts our servers to validate your license. An internet connection is required for activation and periodic validation.
  • We reserve the right to deactivate license keys that are used in violation of these Terms.

6. Your Data

Tagrim processes your media files (photos and videos) entirely on your local device. We do not access, upload, or store your media files. The application collects usage analytics, crash reports, and telemetry data as described in our Privacy Policy.

7. Intellectual Property

The Tagrim application, website, documentation, and all associated intellectual property are owned by Tagrim. These Terms do not grant you any rights to our trademarks, logos, or branding. Your media files and templates remain your property.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Tagrim shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your license to use the application is revoked. Sections that by their nature should survive termination (including limitation of liability and intellectual property) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of North Carolina.
